The regular meeting of the Santa Rosa County Building Code Board of Adjustments and Appeals was held May 13, 2009, at 2:30 p.m. in the conference room of the Santa Rosa County Building Inspection Department located at 6051 Old Bagdad Highway, Milton, FL 32583. Board members present were Mr. Frank Harold, Chairman; Mr. Danny Holt, Vice Chairman; Mr James “Larry” Hall, Mr. William J. Blackman, and Mr. Charles “Pete” Southerland.
Building Inspection Department staff in attendance was Mr. Tim Tolbert, Building Official; Mr. Skip Tompkins, Compliance Division Superintendent; Mr. Randy Jones, Compliance Investigator; Mr. Bobby Burkett, Compliance Investigator and Mrs. Robyn Leverton, Administrative Assistant I.
Mr. Tom Dannheisser, County Attorney, was not present for the meeting.
A court reporter was not present for the meeting.
Mr. Frank Harold, Chairman, called the meeting to order at 2:30 p.m.
Approval of Agenda:
There were no amendments to the agenda. Mr. Southerland made a motion to accept the agenda. Mr. Hall seconded the motion. The motion carried with a unanimous vote.
Approval of Minutes:
Mr. Blackman made a motion to approve the minutes from the April 8, 2009, meeting. Mr. Southerland seconded the motion. The motion carried with a unanimous vote.
The next regularly scheduled meeting is Wednesday, June 10, 2009, at 2:30 p.m. in the Building Inspection Department Conference Room.
New Business-Appeal Building Official’s Decision to Not Consent to a License Reinstatement
David L Butler d/b/a David L Butler - #RB0066593
Robyn Leverton gave some background on Mr. Butler’s license. He has held a registered Building Contractor license in Santa Rosa County since February 1994. In 1999, he failed to renew his license. The ordinance does allow the Building Official the authority to review documentation, from a contractor, that provides proof of active contracting in order to allow reinstatement without retaking the test. Mr. Butler did submit some information to the Building Official however he submitted no proof of active contracting. In his review, Mr Tolbert denied the reinstatement request. Mr. Butler is here today to appeal the Building Official’s decision.
Mr. Butler addressed the Board. He described his work activities as a contract administrator and project manager over the past several years and stated that he hasn’t needed to have his license to pull any permits. He also said that he has remained active with the State of Florida this entire time, keeping up with his continuing education requirements, but does not have an active competency card with any county and did not put his license in inactive status with the county.
A discussion amongst the Board and Mr. Butler ensued.
Mr. Southerland made a motion to deny reinstatement. Mr. Hall seconded the motion. The motion passed with a unanimous vote.
The Board discussed the “Recommended Contractor Fines” schedule.
Mr. Blackman made a motion that the fines be set at a minimum of $250 to a maximum of $5,000 across the board, for all violations. Mr. Southerland seconded the motion. The motion passed with a four to one vote with Mr. Danny Holt opposed.
Mr. Southerland made a motion that monies collected from these fines go to the Building Inspection Department to fund the compliance investigation. Mr. Blackman seconded the motion. The motion passed with a unanimous vote.
Mr. Southerland made a motion that a fined contractor has 30 days to pay the fine, if not paid within the 30 days they loose their privilege to pulls permits in Santa Rosa County. Mr. Blackman seconded the motion. The motion passed with a unanimous vote.
Mr. Hall made a motion to adjourn the meeting. Mr Blackman seconded the motion. The motion carried with a unanimous vote.
The meeting was adjourned at 3:30 p.m.
