The regular meeting of the Santa Rosa County Building Code Board of Adjustments and Appeals was held December 13, 2006, at 3:00 p.m. in the conference roomof the Santa Rosa CountyBuilding Inspection Department located at 6051 Old Bagdad Highway, Milton, FL32583.  Board members present wereMr. Danny Holt, Chairman;Mr. Charles “Pete” Southerland, Vice Chairman;Mr. William J. Blackmanand Mr. James “Larry” Hall.
 

Building InspectionDepartment staff in attendance was Mrs. Rhonda Royals, Deputy Building Official; Mr. Skip Tompkins, Compliance Division Superintendent;Mr. Randy Jones, Compliance Investigator;Mr. Bobby Burkett, Compliance Investigatorand Mrs. Robyn Leverton, Administrative Assistant I.
 

Mr. Tom Dannheisser, County Attorney, was present forthe meeting.
 

Mr. Danny Holt, Chairman, called the meeting to order at 3:02 p.m.
 

A court reporter from Anchor Court Reporting (432.2511)Pensacola, was present for the “Formal Hearing” portion of these minutes.
 

Approval of Agenda:
An amendment was made to move the Probable Cause case, Thompson vs. Daniel E. Danforth d/b/a Dan Danforth Construction, Inc., to the January 2007 meeting. Mr. Blackman made a motion to accept the amended agenda.  Mr. Southerland seconded the motion.  The motion carried witha unanimous vote.
 

Approval of Minutes:
Mr. Southerland made a motion to approve the minutes from the November 8, 2006 meeting.  Mr. Blackmanseconded the motion.  The motion carried witha unanimous vote.
 

Next Meeting:
The next regularly scheduled meeting is Wednesday, January10, 2007, at 3:00 p.m. in the Building Inspection Department Conference Room.
 

Old Business (Formal Hearing)
Santa Rosa County vs. Crista V Hollenbeck d/b/a Crystal Pools

Rhonda Royals introduced the case and stated that this is a continuation of a disciplinary formal hearing regarding Crista V Hollenbeck’s license #RP0040798.  The charge is as listed in previous minutes. The Building Department recommends the Board carry over the case until the next meeting.
 

Mr. Blackman made a motion to table the case until the next meeting as recommended.  Mr. Southerland seconded the motion.  The motion carried with a unanimous vote.
 

Old Business (Formal Hearing)
Santa Rosa County vs. Jeff Milowitz d/b/a Emerald Coast Construction
Rhonda Royals introduced the case and stated that there aretwo permits remaining open that need to be addressed.  One property owner is being uncooperative with the builder as well as the inspection department.  The other permit deals with a scheduling issue.  The Building Department recommends the Board carry over the case until the next meeting.
 

Mr. Blackman made a motion thatMr. Dannheisser send a letter to the uncooperative owner and table the case until the next meeting.  Mr. Hall seconded the motion.  The motion passed with a unanimous vote.
 

Old Business (Formal Hearing)
Santa Rosa County vs.Richard A Pitman d/b/a R A Pitman Jr. Homebuilders

Rhonda Royals introduced the case.  She stated that this case is dealing with the failure to call for required inspections.  Mr. Pittman is a state certified residential contractor, license #CRC1326919.
 

Randy Jones updated the Board regarding the case. He said there are 11 outstanding permits to date.  They are reroof permits that were all issued the last week of August and the first week of September 2005.  None of them have had an inspection requested and all have expired.  Mr. Pitman sent Tom Miller, one of his superintendents, to the office to talk to Randy.  Mr. Miller was not authorized to pull permits for Mr. Pitman, but was going to go back and get the authorizationsigned;however Mr. Pitman’s statelicense and county competency card are outdated so he couldn’t have pulled permits anyway.  Mr. Pitman left Randy a voice message on December 1 st stating that he was trying to get his CEU’s updated and he would be in the office when he could.  Randyrecommends the Board suspend his license until permits are in compliance.
 

Rhonda Royals read the charges.
Alleged Violation of the 2004 Florida Building Code:
Section 109.5 Inspection Requests.  It shall be the duty of the holder of the building permit or their duly authorized agent to notify the buildingofficial when work is ready for inspection.  It shall be the duty of the permit holder to provide access to and means for inspections of such work that are required by this code.
 

Mr. Blackman made a motion of guilty and to suspend Richard A Pitman’s right to pull permits within Santa Rosa County until allcurrent permits come into compliance.  Mr. Southerland seconded the motion.  The motion carried with a unanimous vote.
 

Old Business (Formal Hearing)
Santa Rosa County vs.Leslie Bugg d/b/aGenes Marine Rhonda Royals stated that this is a complaint filed by our department regarding Mr. Bugg’s failure to pull the required permit for a dock.  His locallicense #MC0319462 is currently inactive due to non-payment.
 

Rhonda read the charges.
Alleged Violationof the 2004 Florida Building Code:
Section 105.1 Required Permit.  Any owner or authorized agent who intends to construct, enlarge, alter, repair, move, demolish or change the occupancy of a building or structure shall first make application to the building official and obtain the required permit.
 

Bobby Burkett reviewed the case with the Board stating that the complaint came in anonymously about a dock being built at 3148 Coquina Way in Gulf Breeze.  After observing the dock, the homeowner was contacted;he said that he contracted with Gene’s Marine to build the dock.  As far as the owner knew, the permits had been pulled.  There was never an application submitted to the plan review department.  Bobby as well as the homeowner attempted to contact Leslie Bugg numerous times.  Calls were never returned. Bobby gave the suggestion of license revocation.
 

Mr. Blackman made a motion of guilty and to revoke his license for five (5) years. Mr. Hall seconded the motion.  The motion carried with a unanimous vote.
 

Mr. Blackman made a motion to adjourn the meeting.  Mr.Southerland seconded the motion.  The motion carried with a unanimous vote.
 

The meeting was adjourned at 3:17p.m.
