SANTA ROSA COUNTY
BUILDING CODE BOARD OF ADJUSTMENTS AND APPEALS
August 12, 2009
The regular meeting of the Santa Rosa County Building Code Board of Adjustments and Appeals was held August 12, 2009, at 2:30 p.m. in the conference room of the Santa Rosa County Building Inspection Department located at 6051 Old Bagdad Highway, Milton, FL 32583. Board members present were Mr. Frank Harold, Chairman; Mr. Danny Holt, Vice Chairman; Mr James “Larry” Hall, Mr. William J. Blackman, and Mr. Charles “Pete” Southerland.
Building Inspection Department staff in attendance was Mr. Tim Tolbert, Building Official; Mr. Skip Tompkins, Compliance Division Superintendent; Mr. Randy Jones, Compliance Investigator; Mr. Bobby Burkett, Compliance Investigator and Mrs. Robyn Leverton, Administrative Assistant I.
Mr. Tom Dannheisser, County Attorney, was not present for the meeting.
A court reporter was not present for the meeting.
The cassette recording of this meeting is of very poor quality.
Mr. Frank Harold, Chairman, called the meeting to order at 2:35 p.m.
Approval of Agenda:
There were amendments to the agenda: items number #6 and #7 were postponed until the next meeting. Mr. Southerland made a motion to accept the amended agenda. Mr. Blackman seconded the motion. The motion carried with a unanimous vote.
Approval of Minutes:
Mr. Southerland made a motion to approve the minutes from the May 13, 2009, meeting. Mr. Blackman seconded the motion. The motion carried with a unanimous vote.
The next regularly scheduled meeting is Wednesday, September 9, 2009, at 2:30 p.m. in the Building Inspection Department Media Room.
New Business-Appeal Building Official’s Decision to Not Pursue a case against Field Discount Roofing

Randy Jones gave some background regarding Mr. Hobson’s appeal. Mr. Hobson has some issues with a roof that Florida State Certified, Fields Discount Roofing, license #CCC1327226, has installed on his house. Randy agreed that there are some discrepancies regarding the shingle installation. Since the license holder, Kristi Halphin is state certified, the only charges for which the Board can discipline the contractor is fraud and/or willful code violations. Randy said that he chose to not pursue the case because the homeowner, Mr. Hobson will not allow, Ms. Halphin, d/b/a Fields Discount Roofing, to rectify any items, therefore any code violations cannot be considered “willful”. In Randy’s opinion, the contractor has to be allowed the opportunity to correct the issues. If the contractor refuses to repair any code violations, it would then be considered a “willful” code violation.
A discussion amongst the Board and Mr. Hobson ensued. The Board asked Mr. Hobson if he would allow Fields Discount Roofing onsite to repair the roof. Mr. Hobson answered with a definitive, “No”.
Tim Tolbert concurred saying there is not a willful code violation unless the contractor refuses to fix any violations.
Mr. Southerland made a motion to deny the appeal. Mr. Blackman seconded the motion. The motion passed with a unanimous vote.
Mr. Southerland made a motion to adjourn the meeting. Mr Hall seconded the motion. The motion carried with a unanimous vote.
The meeting was adjourned at 3:07 p.m.
