BOARD OF ADJUSTMENTS AND APPEALS MEETING
MINUTES
MAY 12, 2004
The regular meeting of the Santa Rosa County Building Code Board of Adjustments and Appeals was held May 12, 2004, at 3:00 p.m. in the Conference room of the Santa Rosa County Building Inspection Department located at 6051 Old Bagdad Highway, Room 202, Milton, FL 32583. Board members present were Mr. Charles “Pete” Southerland, Mr. Danny Holt and Mr. William J. Blackman.
Mr. Larry Hall, Chairman and Mr. Frank Harold, Vice Chairman were absent from the meeting.
Building Inspection Department staff in attendance were Mr. Tim Tolbert, Building Official; Mr. Skip Tompkins, Compliance Division Superintendent; Mrs. Rhonda Royals, Deputy Building Official; and Ms. Amy Allen, Permit Analyst.
Mr. Tom Dannheisser, County Attorney was absent from the meeting.
Mr. Southerland called the meeting to order at 3:00 p.m.
Approval of Agenda:
Mrs. Royals stated that there was not an amendment to the agenda. Mr. Blackman made a motion to accept the agenda. Mr. Holt seconded the motion. The motion carried with an unanimous vote.
Approval of Minutes:
Mr. Holt made a motion to approve the minutes from the April 14, 2004 meeting. Mr. Blackman seconded the motion. The motion carried with an unanimous vote.
Next Meeting:
The next regularly scheduled meeting is scheduled for Wednesday, June 9, 2004, at 3:00 p.m.
John & Cindy Hardy VS Thomas Anthony Stuller d/b/a A and L Pools
Mrs. Royals briefly explained this case to the Board. Mr. and Mrs. John and Cindy Hardy filed a complaint with this office against Mr. Thomas Anthony Stuller d/b/a A and L Pools.
Mr. Randy Jones, Compliance Investigator, investigated this complaint. The Board suspended Mr. Stuller’s license in October of 2000. Mr. Stuller made an agreement with the Hardy’s to replace a liner in their swimming pool. Repairs to the pool were made and a new liner was ordered. When delivered the liner was five feet too short. Mr. Stuller left the job and did not return. The pool wall has blown in due to the lack of a liner. The pool has had to be completely repaired.
The Building Department is asking the Board for revocation of Mr. Stuller’s license, then the case could be possibly be turned over to the State for investigation.
Mr. Thomas Stuller was present at the meeting to state his case. Mr. Stuller was friends with the Hardy’s and was asked by them to repair the pool. Mr. Stuller was paid for the materials only.
Mr. Southerland asked Mr. Stuller what work had to be done to the pool. Mr. Stuller
explained that the liner had not been incorrectly measured; the company sent
the wrong liner. Mr. Stuller has tried to correct the problem.
Mr. Blackman asked Mr. Stuller how old the swimming pool was. Mr. Stuller said the pool was about 15 years old. Mr. Stuller told the Board that he had to remove the liner in order to replace it. After the liner was removed, it was discovered that the bottom of the pool had blown in. Mr. Stuller stated that Mr. Hardy had given him $2300.00 for the materials only. This was the only money exchanged.
The Board and Mr. Stuller discussed what had caused the pool bottom to have blown in. Mr. Stuller said that this was due to the ground shifting and because the pool had been constructed incorrectly.
Mr. Holt asked if Mr. Stuller would had to have been a licensed contractor to do this work. He would need a license. Mr. Stuller explained that the Hardy’s did know that he was unlicensed. Mr. Stuller explained that he was no longer in the swimming pool business.
Mr. Blackman made a motion to carry the case to a Formal Hearing in order to resolve the matter. Mr. Holt seconded the motion. The motion carried with an unanimous vote.
New Business (Probable Cause)
Santa Rosa County VS Mr. Donald E. Suggs d/b/a Avalon Pools
Ms. Allen explained to the Board that Avalon Pools had pulled 19 permits. Nine of those permits are expired.
Mr. Ronald Moore from Avalon Pools was present at the meeting to state his case. Mr. Moore explained that the requirements for the latches and alarms are causing him problems when getting a final inspection.
The Board explained that the permits must be inspected. Discussion ensued on the different ways the contractor can prevent the homeowners from using the pool until it had passed a final inspection.
Mr. Blackman made a motion to table the case for one month in order to monitor the progress of the outstanding permits. Mr. Holt seconded the motion. The motion carried with an unanimous vote.
New Business (Probable Cause)
Santa Rosa County VS Mr. Michael Edward Seamon d/b/a Cox Pools
Ms. Allen explained that Cox Pools had pulled 42 permits. Eight of those permits are expired. Cox Pools has paid the reinstatement fee for three of those permits.
Mr. Steven Schriver representing Cox Pools was present at the meeting to state his case. He explained that the homeowners were the problem. Mr. Schriver explained that the homeowners do not want to comply with the codes.
Mr. Blackman asked the contractors to develop some type of system that would allow the final inspection to be done before the pool is ready for use.
Mr. Southerland suggested contacting the homeowner’s insurance company if they will not comply. The contractors agreed that this could be a possible remedy to the problem.
The Board asked Cox Pools to be present at the next month’s meeting to monitor the progress of the expired permits.

Santa Rosa County VS Mr. John W. Gay d/b/a as Panama Pools
Ms. Allen explained that Mr. John W. Gay d/b/a Panama Pools has pulled eleven permits. Of those eleven, eight are expired. Mr. Gay has paid the reinstatement fee for two of the expired permits.
Mr. Gay or another representative from Panama Pools was not present for the meeting.
The Board asked that Mr. Gay be present for the next meeting to evaluate the progress on these inspections.

Santa Rosa County VS Mr. James Wesley Foster d/b/a Dolphin Pools
Ms. Allen explained to the Board that Dolphin Pools has pulled 30 permits. Of those 30 permits, nine are expired.
Mr. Foster was present at the meeting to state his case. Mr. Foster explained to the Board that he too is having trouble getting the homeowners to comply with the code requirements. Mr. Foster will try to contact insurance companies if the homeowners will not comply.
The Board asked that Mr. Foster be present at the next month’s meeting to evaluate the progress of the inspections.
New Business (Probable Cause)
Santa Rosa County VS Mr. Robert W. Siyufy d/b/a Roberts’ Pools
Ms. Allen explained that Roberts’ Pools has pulled 73 permits. Of those 73 permits, 8 are still expired. Roberts’ Pools has paid the reinstatement fee for four of the expired permits.
Mr. Robert W. Siyufy Jr. was present at the meeting to state his case. Mr. Siyufy explained that the alarm inspection has caused problems for their finals. Mr. Randy Jones explained the sequence of inspections to the Board.
The Board asked Roberts’ Pools to be present at the next month’s meeting to evaluate the progress of the inspections.
The Board asked that the next five contractors with expired permits be requested to attend a Probable Cause meeting next month.
Mr. Southerland adjourned the meeting at 4:15 p.m.
