BOARD OF ADJUSTMENTS AND APPEALS MEETING

MINUTES

MAY 14, 2003

 

The regular meeting of the Santa Rosa County Building Code Board of Adjustments and Appeals was held April 9, 2003, at 3:00 p.m. in the Conference room of the Santa Rosa County Building Inspection Department located at 6051 Old Bagdad Highway, Room 202, Milton, FL 32583.  Board members present were Mr. Charles “Pete” Southerland, Chairman; Mr. Larry Hall, Vice-Chairman; Mr. Frank Harold, Mr. Jeff Ates, and Mr. Danny Holt. 

 

Building Inspection Department staff in attendance was Mr. Martin Riley, Building Official; Mr. Skip Tompkins, Field Superintendent; Mrs. Rhonda Royals, Building Department Coordinator; and Ms. Amy Allen, Permit Analyst.

 

Mr. Tom Dannheisser, County Attorney was absent from the meeting.

 

Mr. Southerland, Chairman; called the meeting to order at 3:03 p.m.

 

Approval of Agenda:

There were no new cases added to the agenda; however, a memo from Mr. Dannheisser regarding the Florida Sunshine Law was presented to the Board.  Mr. Harold made a motion to accept the agenda.  Mr. Hall seconded the motion.  The motion carried with an unanimous vote.

 

Approval of Minutes:

Mr. Harold made a motion to approve the minutes from the April 9, 2003 meeting.  Mr. Hall seconded the motion.  The motion carried with an unanimous vote.

 

Next Meeting:

The next regularly scheduled meeting is scheduled for Wednesday, June 11, 2003, at 3:00 p.m.

 

Old Business (Formal Hearing)

David Hannah VS Raymond Noel d/b/a Reve Development

Mrs. Royals briefly explained the case to the Board.  Mr. Hannah and Mr. Noel with Reve Development were working out an agreement between the two.  Both parties asked for a continuation of the case.  They hoped the case would be resolved by the next meeting.  Progress had been made.  The builder decided to give Mr. Hannah credit for a new roof.  The Hannah’s have hired another contractor to replace the metal roof in question.  The new roofer has purchased a permit.

 

Mr. Holt made a motion to continue the case to the next month’s meeting.  Mr. Harold seconded the motion.  The motion carried with an unanimous vote.

 

New Business (Probable Cause)

Jay First Assembly of God VS Roger Williams d/b/a Williams Engineering

Mrs. Royals explained that Jay First Assembly of God hired Williams Engineering to install a new roof on the church.  A complaint was filed against Mr. Williams regarding a roofing problem.  At the April Board of Adjustments and Appeals meeting, the Board decided to give Mr. Williams 30 days to get the roof problems corrected.  Mr. Williams has corrected the problems and a final inspection has been completed. 

 

Mr. Harold made a motion to dismiss the case.  Mr. Hall seconded the motion.  The motion carried with an unanimous vote.

 

New Business

Michael Bunyan

Mrs. Royals briefly explained the case to the Board.  Mr. Bunyan was before the Board regarding a complaint filed against him.  The complaint dealt with the placement of a sea wall.  The Board imposed a two year suspension of Mr. Bunyan’s marine contractor’s license. 

 

The ordinance for Santa Rosa County states that if a contractor is disciplined against his license for more than one year, the contractor must retake the contractor’s test in order to have his license reinstated.  Last year a petition was made by several marine contractors to the Santa Rosa County Board of County Commissioners to allow marine contractors the opportunity to be grandfathered into the system, since marine contractors were no longer regulated by the State of Florida.  The testing agency the State of Florida uses for contractors no longer has an exam for light marine contracting.  Santa Rosa County adopted an ordinance allowing marine contractor’s to be given a license in the county if they could prove they had been in business as a marine contractor for five years.  If the five years had been met, the county would grant them a license. 

 

The ordinance expired three days before Mr. Bunyan’s revocation period had been completed.  Mr. Bunyan is seeking approval from the Board to have his license reinstated without testing.

 

Mr. Bunyan was in attendance to state his case.  Mr. Bunyan had owned a business for twenty-two years called B & B Marine.  Mr. Bunyan explained the situation of the complaint previously filed to the Board.  Mr. Bunyan presented to the Board a copy of his wages from the previous year.  Mr. Bunyan asked the Board if they would grant him the ability to return to work.

 

The previous complaint was filed in March of 2001.  Mr. Bunyan explained that he had placed the sea wall in the direction according to the homeowner.  The formal complaint outlined the violation of the state law according to the placement of the sea wall.  The Board found Mr. Bunyan in violation of the state law and revoked his license for two years.

 

Mr. Hall made a motion to reinstate Mr. Bunyan’s license.  Mr. Holt seconded the motion.  The motion carried with an unanimous vote.

Mr. Southerland reviewed the Florida State Sunshine Law from Mr. Dannheisser.

 

Mr. Harold made a motion to adjourn the meeting.  Mr. Hall seconded the motion.  The motion carried with an unanimous vote.

 

Mr. Southerland adjourned the meeting at 3:21 p.m.
