BOARD OF ADJUSTMENTS AND APPEALS MEETING
MINUTES
JUNE 11, 2003
The regular meeting of the Santa Rosa County Building Code Board of Adjustments and Appeals was held June 11, 2003, at 3:00 p.m. in the Conference room of the Santa Rosa County Building Inspection Department located at 6051 Old Bagdad Highway, Room 202, Milton, FL 32583. Board members present were Mr. Charles “Pete” Southerland, Chairman; Mr. Jeff Ates, and Mr. Danny Holt.
Board members Mr. Larry Hall, Vice-Chairman and Mr. Frank Harold were absent from the meeting.
Building Inspection Department staff in attendance was Mr. Martin Riley, Building Official; Mr. Skip Tompkins, Field Superintendent; Mrs. Rhonda Royals, Building Department Coordinator; and Ms. Amy Allen, Permit Analyst.
Mr. Tom Dannheisser, County Attorney was absent from the meeting.
Mr. Southerland, Chairman; called the meeting to order at 3:10 p.m.
Approval of Agenda:
There were no additions to the agenda. Mr. Holt made a motion to accept the agenda. Mr. Ates seconded the motion. The motion carried with an unanimous vote.
Approval of Minutes:
Mr. Holt made a motion to approve the minutes from the May 14, 2003 meeting. Mr. Ates seconded the motion. The motion carried with an unanimous vote.
Next Meeting:
The next regularly scheduled meeting is scheduled for Wednesday, July 9, 2003, at 3:00 p.m.
David Hannah VS Raymond Noel d/b/a Reve Development
Mrs. Royals asked the Board to continue the case. Both parties have reached an agreement which the Building Department has received. There were punch-list items the builder needed to address before the case could be withdrawn. The Board decided to continue the case.
New Business (Probable Cause)
Lucille G. Sumrall VS Curtis Salter d/b/a Salter Roofing Company
Mrs. Royals briefly explained the case to the Board. Mr. Randy Jones, Inspector III, was the investigator for this complaint. Mr. Jones discussed the case with the Board. Mr. Salter re-roofed Ms. Sumrall’s house in January of 1998. The Building Department started permitting roofs and re-roofs in December of 1998.
Mrs. Sumrall contacted the Building Department in March of 2003 with roof leakage. Mr. Salter had completely re-roofed the house. The roof leaked shortly after Mr. Salter finished the roof. Mr. Salter did make the repairs; however, it leaked again in another place. The specific leaks were repaired although leaks still occurred. Mr. Jones could not find any code violations on the roof. There was a problem with the flashing around the chimney and the ceiling in the garage.
Mr. Jones used photographs to explain the issues with the roof. There were places on the roof where the nails had pulled through the shingles.
Ms. Sumrall was in attendance to state her case. Ms. Sumrall experienced several leaks since the roof was completed. Mr. Salter and his crew came back to repair the roof each time a leak was experienced. The leaks were occurring in different places.
Ms. Sumrall has had difficulty getting in contact with Mr. Salter; however, he or one of his staff would come to repair the leaks. Ms. Sumrall stated that the roof had a one year warranty.
Mr. Southerland and Ms. Sumrall discussed the possibility of Mr. Salter re-roofing the house. Ms. Sumrall was not willing to have Mr. Salter re-roof the house. Mr. Southerland explained to Ms. Sumrall that the Building Inspection Department is now inspecting roofs.
Ms. Sumrall explained that she would like Mr. Salter to pay another roofer to repair the roof. She wanted him to pay for the labor and a portion of the materials.
Mr. Salter was in attendance to state his case. Mr. Salter explained that four to five leaks were experienced on the house. There was a major leak around the chimney. Mr. Salter and his staff re-flashed the chimney and stopped the leak. Mr. Salter had someone paint the ceiling from the leak at the chimney.
A leak occurred over a vent for the stove. The leak was repaired and stopped leaking. Mr. Salter told Ms. Sumrall in previous conversation that he would replace the entire roof. She did not want Mr. Salter to do the work.
Mr. Salter discussed the possibility of him paying for a new roof for Ms. Sumrall. Mr. Salter and the Board discussed the roof and the construction of the roof. Mr. Salter does not know why the roof has leaked.
Mr. Salter explained that even after the one-year warranty expired, he is still returning to the site to make repairs. The Board and Mr. Salter discussed the leaks and where the leaks were located.
The Board discussed a leak that had occurred on the front porch. This leak was the latest leak Mrs. Sumrall had experienced. Mr. Salter and Mr. Jones discussed the installation process of the shingles.
Mr. Salter explained that repairing the leak is not a problem, finding the leak is where the difficulty falls. Mr. Holt and Mr. Salter discussed some of the roofing nails that had pulled out over the years.
Mr. Southerland and Ms. Sumrall discussed having the roof repaired. Mr. Ates explained to the Board that Mr. Salter had returned to the job to repair the roof each time a leak had occurred.
Mr. Holt made a motion to dismiss the case. Mr. Ates seconded the motion. The motion carried with an unanimous vote.
Mr. Holt made a motion to adjourn the meeting. Mr. Ates seconded the motion. The motion carried with an unanimous vote.
Mr. Southerland adjourned the meeting at 4:21 p.m.
